For users in Switzerland, the Swiss Data Protection Act (DSG/FADP), the Data Protection Ordinance, and Art. 45c of the Telecommunications Act (FMG/TCA) apply in particular to cookies and similar technologies. Under Article 45c of the TCA, the processing of information on third-party devices via telecommunications transmission is permitted if it is necessary for telecommunications services and billing purposes, or if users are informed about the processing, its purpose, and the option to opt out. To the extent that cookies or comparable technologies involve personal data, the principles of the DSG must also be observed, in particular transparency, proportionality, purpose limitation, data security, and, where applicable, the requirements for consent. According to the guidelines of the EDÖB/FDPIC, technically necessary cookies are generally permissible without separate consent, provided they are transparently disclosed. Analytics, marketing, profiling, and third-party tracking technologies, on the other hand, require particularly careful review; in cases of intensive tracking, third-party tracking, personalized advertising, profiling, or high risk, explicit consent may be required.
